Notably, we have successfully represented a manufacturer of ignition interlock devices seeking a contract with the Department of Highway Safety and Motor Vehicles. The contract was initially awarded to another competitor. We challenged the contract award and also filed an administrative rule challenge contesting the agency’s authority to award a contract to a single vendor. We successfully invalidated the challenged administrative rule and received an attorney fee award against the agency. The successful rule challenge also prohibited the agency from awarding a contract to the competitor. In the interim, we have assisted the client’s lobby team in adopting new legislation allowing the client to distribute its products within Florida.

We represented a slot machine manufacturer concerning the legality of electronic roulette machines. The client was unable to distribute its devices within Florida due to an administrative rule prohibiting their classification as legal slot machines. We successfully challenged the administrative rule and the ruling was upheld on appeal. We also successfully represented the client before the Florida Legislature to ensure the court’s ruling was not invalidated by legislative act.

We successfully represented a health care association challenging the Agency for Health Care Administration’s contract procurement for mail-order pharmacy services. The representation included an administrative challenge to the bid protest and a constitutional challenge to the Agency’s authority. The Agency ultimately withdrew the proposed contract procurement.

We successfully represented a casino operator applying for a new gaming permit in Miami-Dade County. The Division of Pari-Mutuel Wagering denied the application on the basis that a gaming permit was not available to be issued. We appealed the application’s denial to the First District Court of Appeal’s and successfully obtained an order reversing the denial on the basis that Florida law did not support the agency’s decision.
